Re: MPC Information

Attached you will find an "Information Sheet" on Milk Protein Concentrate compiled by USDEC & DMI staff on January, 2001.

We are enclosing for your review a copy of the "Harmonized Tariff Schedule of the United States (2001)" which correctly reflects the current duty rate on MPC.  The duty rate on MPC is not 10% as stated in the USDEC/DMI staff paper; it is $.0037 per kilogram.

What does this mean?  Here's a comparison based on an import of 100,000 kilos (220,460 lbs.) with an FOB price of $1.00 per lb for MPC that is 42% protein.  Please note that MPC comes with many different protein levels from many different countries.  The higher the protein level - the higher the price.

The example below is based on a hypothetical price of $1.00 per lb FOB country of origin which we believe is an accurate assessment of the cost of MPC with 42% protein in the year 2000.  One kilo equals 2.2046 lbs; therefore, at $1.00 per lb. this is equal to $2.2046 per kilo.

Actual Duty  (2001 Tariff Schedule)

$.0037 per kilo X 100,000 kilos = $370.00

USDEC/DMI Purported Duty (10% duty)

100,000 kilos X$2.2046 X 10% = $22,046.00
